How it got here

Council refused both the Official Plan amendment and the draft plan of subdivision on September 29. The City's decision notices set 4:30 p.m. on October 28 as the last time to appeal either refusal to the Ontario Land Tribunal, with appeals filed through the City Clerk. On October 23 the City said the Province had made zoning orders that permit approximately 138 single-detached homes and townhouses across six areas of the golf course lands, and add long-term care and retirement homes as permitted uses at 4274 Dundas Street, and that City staff were reviewing them.

  • Official Plan amendment refusal: the City's notice says only the Minister, the appropriate approval authority, and the person or public body that made the request can appeal it.
  • Draft plan of subdivision refusal: the City's notice says the applicant, the Minister, or a specified person as defined in the Planning Act or a public body that made oral or written submissions before Council decided can appeal it.

What is not known

The project page does not say who filed the appeal, whether it concerns the Official Plan amendment, the subdivision or both, or whether a hearing has been scheduled. As of October 30 the City had issued no news release about an appeal; its most recent Millcroft release is the October 23 statement on the zoning orders. The Ontario Land Tribunal says a newly filed appeal appears on its online case status service once the Tribunal has received and processed it, which may take a number of weeks.
